As a client of the Law Offices of Michael Gomez, P.A. we will help you through any consumer law and credit issue you may be facing. We represent clients throughout South Florida and help resolve issues with Fair Credit Reporting Act (FCRA) and Fair Debt Collection Practices Act (FDCPA) claims.
If your identity has been stolen, or you are being harassed and threatened by your creditors, you need a lawyer to file these legal claims on your behalf. Contact our Fort Lauderdale area office by calling 954-416-2164 or by contacting us online for a free initial consultation.
Repairing Your Credit With FCRA Claims
The recent economy has put us back into a position where credit scores are more critical than ever. If you need your credit fixed, you need it done quickly. This generally consists of reviewing your credit report with you and filing a Fair Credit Reporting Act claim. We file legal actions against the credit reporting agencies and debt collectors to correct your credit report.
We typically assist clients in credit repair after:
- Identity theft
- Divorce
- Bankruptcy
If your identity has been stolen, it's best to get a lawyer's help. If you don't have a lawyer handle the credit repair with a FCRA claim, your credit problems won't be completely resolved and you will potentially experience more problems in the future.
Stopping Abuse and Prohibited Conduct With FDCPA Claims
The Fair Debt Collection Practices Act was put in place to limit and eliminate abusive or harassing conduct by debt collectors. Despite having numerous regulations in place, not all creditors follow them.
The list of abusive and deceptive tactics includes:
- Abusive or profane language
- Threatening arrest or legal action
- Misrepresentation or deceit — claiming to be law enforcement or an attorney
- Contacting a person while they're at work
- Contacting a person known to have an attorney
- Hours of contact — No calling before 8 a.m. or after 9 p.m. local time
When my clients experience a violation of these federal regulations, I put an end to the problem with a FDCPA claim. Though I cannot erase debt, I can make people follow the rules. Though the biggest problem is harassing phone calls, I help my clients sue debt collectors for damages and injunctive relief, and I defend against debt collection lawsuits.
